Whack-A-Mole is in session as The Gathering Storm has been uploaded to various sites after it was taken down from YouTube by CBS and Paramount.

YouTubers have been helping out the Axanar cause though some of those YouTubers are considered to be questionable characters.

It is very clear what Axanar thinks of the situation in a new three-and-a-half-minute video, and it feels like that this is the situation that was wanted all along, like they knew The Gathering Storm wasn’t going to meet requirements.

Here is one example of Axanar breaking the agreement.

Section 5.5 states ‘The Permitted Axanar Segments may use the services of Robert Meyer
Burnett, Gary Graham, Kate Vernon, Richard Hatch and J.G. Hertzler. Defendants will not use
the services of any other actors that have previously worked on any authorized Star Trek
production.’

That means that Faran Tahir, Patricia Tallman and Tony Amendola should not have been in The Gathering Storm, heck Faran Tahir was reprising a character from Star Trek (2009).

Here is another part of the settlement ‘These Permitted Axanar Segments shall conform to the Guidelines in all respect‘ and it is obvious to everybody that The Gathering Storm does not follow the guidelines in all respect.

Then there is this part, section number three

‘The Parties hereby agree that they will not, directly or indirectly publicly disparage, in print or in any other media (including but not limited to social media), or in any public speaking platform, any of the other Parties or their employees or agents, that may harm the business interests of any of the other Parties, including, without limitation, making any such
remarks involving or referring to any of the Parties’ business practices. The term disparagement
shall not include the recital of any information that is in the public record.‘

This one has definitely been broken as Axanar has never been shy of stating opinions about the company.

Axanar’s hopes appear to be placed on the below

In the event of a breach by any Party of this Agreement, the non-breaching Party shall send written notice of such breach to the allegedly breaching Party. If such breach is not completely cured within ten (10) business days of the sending of such notice (which notice shall be sent by both e-mail and regular mail to the addresses provided below), the non-breaching party may commence a proceeding for such breach as provided in this paragraph.

The interesting is that if they ‘cure’ it by removing Faran Tahir, Patricia Tallman and Tony Amendola, you’re going to have a fan film with lots of holes in it and there may be other issues with it as well that are outside the agreement.

If Axanar followed its settlement and the guidelines to the very last letter, The Gathering Storm would have been released with no problem at all, and this is something that very few people think about, people reach for the worst option without thinking of how things came to be.

Some think that CBS and Paramount should let Axanar go and make the two fifteen-minute parts the way they want to, but wouldn’t that be rewarding bad behaviour? You’ve broken all these rules and as a reward we let you have all these professionals and everything else you’re not supposed to have.
